These Terms of Service ("Terms") govern your access to and use of the Luminix marketing website at luminixops.com (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Access to the Luminix product platform is subject to a separate written or click-through customer agreement between you and Luminix. These Terms do not govern your use of the product unless expressly stated in that agreement.
Permitted use
You may browse the Site and submit demo requests for legitimate business purposes related to restaurant operations software. You agree not to:
- Use the Site in violation of applicable law
- Attempt to gain unauthorized access to our systems or data
- Interfere with or disrupt the Site or its infrastructure
- Scrape, copy, or republish Site content without permission
- Submit false or misleading information through the contact form
Demo requests
Submitting a demo request does not create a customer relationship or obligation to purchase. We may follow up using the contact information you provide. You represent that the information you submit is accurate and that you are authorized to inquire on behalf of your organization.
Intellectual property
The Site, including text, graphics, logos, product screenshots, and software previews, is owned by Luminix or its licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent, except as permitted by law.
Product information
Descriptions of modules, integrations, and capabilities on the Site are for general information and may change as the product evolves. Features shown in previews or demos may differ from your provisioned environment. Specific functionality, pricing, and service levels are defined in your customer agreement, not on this Site.
Third-party links and integrations
The Site may reference third-party products (for example, POS or accounting systems).Luminix is not responsible for third-party websites, services, or trademarks. Your use of third-party services is subject to their terms.
Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINIX AND ITS FOUNDERS, OFFICERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Indemnification
You agree to indemnify and hold harmless Luminix from claims arising out of your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute relating to the Site shall be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
